PROPOSED AGREEMENT
Vendor: Indiana Harbor Belt Railroad Company (“IHBRC”), Hammond, Indiana
Request: Requesting authorization for the Forest Preserves of Cook County (the “Forest Preserves”) to enter into a license agreement with IHBRC for installation and maintenance of water conveyance infrastructure on IHBRC property.
Reason: The Forest Preserves is proposing to enter into a License Agreement with IHBRC to provide access and right of entry to the Forest Preserves and its authorized contractors for the construction, operation and maintenance of a section of 24-inch storm sewer outlet pipe under IHBRC property. This work is associated with a grant-funded project to install a water control structure and fish passage system at Powderhorn Lake (Board Item No. 20-0169 and Board Item No. 21-0451), a portion of which transverses land owned by the railroad. The Forest Preserves will complete the proposed work and assume future maintenance responsibility for the pipe in accordance with the approved construction plans.
Contract Period: Date of execution - 5/31/2036, with continuous automatic renewals unless cancelled by either party.
Estimated Fiscal Impact: $1,000.00 one-time licensing fee
