BE IT ORDAINED, by the Board of Commissioners of the Forest Preserve District of Cook County, that Title 5, Public Utilities, Chapter 2, Franchises, Sections 5-2A-5 (Tree Mitigation) and 5-2B-5 (Tree Mitigation) of the Forest Preserve District of Cook County Code is hereby amended as follows:

Sec. 5-2A-5. Tree Mitigation.

In accordance with the District's Tree Mitigation Plan adopted by the Forest Preserve District of Cook County Board of Commissioners on March 21, 2007 and as amended from time to time by the Board, an applicant for a license pursuant to Section 5-2A-1 shall include in its plan a survey indicating the species, size, and geospatial location of each live or dead tree to be removed and the proposed timeframe for removal, and designating plots across the proposed project corridor detailing concentrations of coarse woody debris to be impacted by the requested license. The District shall use this information to determine the total tree mitigation fee that shall be paid by the licensee.
All plans submitted will include a listing of all trees over four (4) inches in diameter breast height (DBH) that will be removed from FPD property as a result of construction of the proposed facilities. This list will include the DBH, common name, and species name for each tree to be removed. Plans will also indicate the location of the trees to be removed, identity of each individual tree and indicate that it is to be removed by showing an "X" through the tree symbol on the plans. The FPD will use this information to determine the tree mitigation fee using the FPD's tree mitigation plan as adopted by the Board of Forest Preserve District Commissioners on March 21, 2007, and as further amended by the Forest Preserve District Board of Commissioners.
