PROPOSED RESOLUTION

 

TO AUTHORIZE THE FOREST PRESERVES OF COOK COUNTY TO ENTER INTO LOCAL AGENCY AND ENGINEERING SERVICE AGREEMENTS FOR CONSTRUCTION MANAGEMENT OF THE SAND RIDGE BICYCLE TRAIL

 

WHEREAS, the Forest Preserves of Cook County (the “Forest Preserves”) has sought and been awarded funds from the Illinois Transportation Enhancement Program (“ITEP Grant”), a federally-funded program administered by the Illinois Department of Transportation (“IDOT”), to facilitate the construction of 1.3 miles of the Sand Ridge Bicycle Trail (hereafter the “Project”); and

 

WHEREAS, IDOT requires a resolution to reaffirm the Forest Preserves funding commitment for Phase III Engineering (construction management) and Construction costs associated with the Project as per the Local Agency Agreement; and

 

WHEREAS, the Local Agency Agreement also provides for the division of Phase III and Construction costs for the Project and payment of 20% of the engineering and construction costs by the Forest Preserves as the Local Agency; and

 

WHEREAS, ITEP provides 80% (or maximum of $56,000.00) of Phase III Engineering costs for the Project estimated at $70,000.00; and

 

WHEREAS, in order to meet deadlines for use of the funds provided via the ITEP Grant, IDOT recommends that a consulting engineering firm be employed to perform Phase III Engineering construction management services; and

 

WHEREAS, in 2013, the Forest Preserves issued an RFQ for Phase I, II, and III Engineering Services and  subsequently selected Christopher B. Burke Engineering, Ltd., Rosemont, Illinois (CBBEL) to serve as Consulting Engineers for Phases I, II and III; and

 

WHEREAS, CBBEL’s Phase III Engineering costs are $69,696.55, ITEP  funds will cover 80% ($ 55,757.24) of the costs of Phase III Engineering Services to be provided in connection with the Project and the Forest Preserves shall be responsible for 20% of the cost of Phase III Engineering or $13,939.31 in connection with the Project; and

 

WHEREAS, ITEP provides 80% (or maximum of $546,000.00) of Construction costs for the Project estimated at $682,000.00; and the Forest Preserves 20% local share of the construction cost is estimated at $ 136,500.00; and

 

WHEREAS, IDOT is responsible for the bid letting and award of construction contracts and has accepted an apparent low bid from Iroquois Paving Corporation in the amount of $607,080.16; and

 

NOW, THEREFORE BE IT RESOLVED that the Board of Commissioners of the Forest Preserves hereby authorizes the Forest Preserves, through its President, to enter into a local agency agreement (the “Local Agency Agreement”), with the Illinois Department of Transportation (“IDOT”) to pay construction and phase III engineering service costs associated with the Project, subject to reimbursement of 80% by IDOT. 

 

NOW, THEREFORE BE IT RESOLVED that the Forest Preserves of Cook County Board of Commissioners hereby authorize the Forest Preserves to pay 20% of the construction cost to IDOT pursuant to the Local Agency Agreement. 

 

BE IT FURTHER RESOLVED that Christopher B. Burke Engineering, Ltd, of Rosemont Illinois be employed to perform Phase III Engineering services in connection with the Project, and that the President of such Board of Commissioners is hereby directed to execute, on behalf of the Forest Preserves, an agreement by and between the Forest Preserves and CBBEL for Phase III Engineering services (the “Engineering Services Agreement”).

 

BE IT FURTHER RESOLVED that, the Forest Preserves of Cook County Board of Commissioners  hereby confirms that sufficient funds are available in the Forest Preserves Construction & Development Fund Trail accounts 51009.560063, 51025.560063, 51054.560063, 51055.560063, 51055.560063, 51057.560063, 51058.560063; and Construction and Management Service accounts 51009.520860, 51025.520860, 51054.520860, 51055.520860, 51056.520860, 51057.520860, 51058.520860, and Grant account 51010.520860, and have been designated, to pay the total cost of Phase III Engineering services in the amount not to exceed $69,696.55 of which the Illinois Department of Transportation will reimburse 80% or up to $55,757.24  and the Forest Preserves’ ultimately shall be responsible for 20% of the Phase III Engineering costs or a maximum of $13,939.31, in addition to, 20% of construction costs not to exceed $136,500.00.

 

BE IT FURTHER RESOLVED that copies of the Local Agency Agreement and the Engineering Services Agreement for Federal Participation, when executed in their respective final form, shall be submitted to the IDOT for approval and final processing.end
