PROPOSED RESOLUTION

 

TO AUTHORIZE THE DISTRICT TO PAY THE ILLINOIS DEPARTMENT OF TRANSPORTATION (IDOT) THE LOCAL SHARE OF CONSTRUCTION COSTS FOR THE NORTH BRANCH BICYCLE TRAIL SOUTHERN EXTENSION-STAGE 2 AND AMEND A LOCAL AGENCY AGREEMENT

 

WHEREAS, the Forest Preserve District of Cook County (the “Forest Preserves”) has sought and been awarded, funds from the Congestion Mitigation Air Quality (“CMAQ”) federal grant program administered by the Illinois Department of Transportation (“IDOT”) for the construction of a 2.96 mile southern extension of the North Branch Bicycle Trail (hereafter the “Project”); and

 

WHEREAS, on October 10, 2014, the Board of Commissioners authorized the Forest Preserves to enter into a local agency agreement (the “Local Agency Agreement”), with IDOT to pay 20% of the Phase III Construction Engineering ($530,000.00) costs and estimated Construction costs ($6,710,000.00) associated with the Project; and

 

WHEREAS, due to the amount of available funding, the Project was divided into two stages: Stage 1 from Devon and Caldwell Avenue to Forest Glen Avenue and, Stage 2 from Forest Glen to Foster & Kostner Avenues; and

 

WHEREAS, federal funds available for Stage 2 of the Project total $2,000,000.00 ($1,600,000.00 in Transportation Alternative Program (“TAP”) funds and $400,000.00 in CMAQ funds (both administered by IDOT); and

 

WHEREAS, on January 12, 2016, the Forest Preserves Board of Commissioners authorized the Forest Preserves to enter into an additional Local Agency Agreement for Stage 2 construction and authorized payment not to exceed $400,000.00, representing approximately 20% of the cost of Stage 2 construction; and

 

WHEREAS, IDOT received a low bid in the amount of $2,343,699.50 for the construction of Stage 2 of the Project; and

 

WHEREAS, based on an estimated construction cost of  $2,343,699.50,  IDOT will be responsible for  up to $2,000,000.00 and the Local Agency will be responsible for up to $500,000.00; and 

 

WHEREAS, the fiscal impact for the Forest Preserves, as the Local Agency, will be up to $500,000.00; and

 

WHEREAS, IDOT requires that the Forest Preserves execute a Local Public Agency Amendment to reflect increased costs for Stage 2 of the Project; and

 

NOW, THEREFORE BE IT RESOLVED that the Board of Commissioners of the Forest Preserve District of Cook County hereby authorize the Forest Preserves to amend the Local Agency Agreement to include the additional TAP funds ($1,600,000.00) with “CMAQ” funds ($400,000.00) received for the Project and for authorization to pay up to $500,000.00 of the construction cost for Stage 2 of the Project to IDOT pursuant to the Local Agency Agreement as amended. The total estimated construction cost for the Project including Stage 1 and 2 is now $7,705,889.33 and the District is responsible for 20% of such amount or $1,541,177.87. end
