PROPOSED RESOLUTION

 

TO AUTHORIZE THE DISTRICT TO ENTER INTO LOCAL AGENCY AGREEMENT FOR STAGE 2 CONSTRUCTION -  NORTH BRANCH BICYCLE TRAIL-LAKE COOK ROAD EXTENSION

 

 

WHEREAS, an Illinois Transportation Enhancement Program (“ITEP Grant”), has been awarded to the Forest Preserve District of Cook County (the “District”) by the Illinois Department of Transportation (“IDOT”) to construct 1.0 mile of the North Branch Bicycle Trail-Lake Cook Road Extension to the Green Bay Trail (hereafter the “Project”); and

 

WHEREAS, $1,651,880 in “ITEP” funding was awarded for construction of the entire project.

 

WHEREAS, to expedite construction, the project was divided into two stages, Stage 1 which includes one mile of paved trail from the Chicago Botanic Garden to Lake Cook Road and Stage 2 which provides an at-grade trail crossing of the Union Pacific Railroad and a direct connection to the Green Bay Trail.

 

WHEREAS, on November 12, 2013, the Board of Commissioners authorized the District to enter into a local agency agreement (the “Local Agency Agreement”), with the Illinois Department of Transportation (“IDOT”) for Stage 1 Construction costs associated with the Project, estimated at $1,445,615.00 of which IDOT will be responsible for 80% ($1,156,492.00) and the Local Agency 20% ($289,123.00);

 

WHEREAS, upon the final closeout of Stage 1 construction it is anticipated the unused ($63,753.00) federal funds from Stage 1 will be transferred to Stage 2; 

 

WHEREAS, the Forest Preserve has reached an agreement with the Union Pacific Railroad who has provided an estimate of $301,836.00 for construction of the at-grade crossing performed under a force account contract administered by the railroad. 

 

WHEREAS, Stage 2 construction, the at-grade crossing of the Union Pacific Railroad is estimated at $301,836 plus 10% contingency ($332,019.60) of which IDOT will be responsible for ($208,000.00) and the Local Agency ($124,019.14).  Upon the final closeout of Stage 1 construction it is anticipated the unused ($63,753.00) federal funds from Stage 1 will be transferred to Stage 2 reducing the Local agency share to ($60,266.60). 

 

WHEREAS, the District will be reimbursed partially or fully for Local Agency costs by the Chicago Botanic Garden (“Garden”) pursuant to an Agreement with the Garden.

 

NOW, THEREFORE BE IT RESOLVED that the Board of Commissioners of the Forest Preserve District of Cook County hereby authorize the District to pay for the construction cost to the Union Pacific Railroad pursuant to the Local Agency Agreement. 

 

NOW, THEREFORE BE IT RESOLVED that the Board of Commissioners of the District hereby authorizes the District, through its General Superintendent, to enter into a local agency agreement (the “Local Agency Agreement”), with the Illinois Department of Transportation (“IDOT”) to pay Construction costs associated with the Stage 2 of the Project. 

 

 

BE IT FURTHER RESOLVED that, the Board of Commissioners of the District hereby confirms that sufficient funds are available in the District’s Capital Improvement Fund accounts, and have been designated, to pay the total cost of  construction costs in the amount not to exceed $332,019.60  of which the Illinois Department of Transportation will reimburse $271,819.00  ($208,000.00 + $63,753.00) and the District ultimately shall be responsible for the balance of Stage 2 construction costs or a maximum of $60,266.60.

 

BE IT FURTHER RESOLVED that copies of the Stage 2 Local Agency Agreement when executed in its final form, shall be submitted to the Illinois Department of Transportation for approval and final processing.
