PROPOSED RESOLUTION

 

REQUEST FOR GENERAL SUPERINTENDENT AUTHORITY TO APPROVE AND EXECUTE ELECTRIC FACILITIES AGREEMENTS

 

WHEREAS, the Forest Preserves of Cook County (the "Forest Preserves") from time-to-time desires to upgrade its electricity service at various facilities; and

 

WHEREAS, such upgrades may require the installation of transformers or other equipment from Commonwealth Edison ("ComEd"), regardless of whether electricity service is ultimately provided by ComEd or another electricity supplier; and

 

WHEREAS, ComEd retains ownership of such transformers and other equipment and requires the Forest Preserves, as the customer, to sign and execute various agreements that cover a monthly rental and other ancillary fees; and

 

WHEREAS, such agreements are form agreements that include rates and non-standard provisions and riders that can be unilaterally changed by ComEd subject to appropriate regulatory approval, including, without limitation, a perpetual agreement term length, provided, however, that the agreements may be terminated upon termination of service; and

 

WHEREAS, fees due under such rental agreements are either paid under the terms of the agreements or paid separately via the actual services agreements; and

 

WHEREAS, ComEd requires customers to return executed agreements promptly, typically within thirty (30) days, to secure an order for such equipment; and

 

WHEREAS, pursuant to Board Item No. 25-0296 (as updated via Board Item No. 26-0318 on July 2026 agenda), Forest Preserves’ staff submit an annual report to the Board of Commissioners of energy-related expenses in the previous year.

 

NOW, THEREFORE, BE IT RESOLVED, that the Forest Preserves of Cook County Board of Commissioners does hereby authorize the Forest Preserves’ General Superintendent to approve and execute all agreements for the rental and installation of transformers and other electric equipment from ComEd, provided the spend is subject to the aggregate $1.75 million annual expense cap under Board Item No. 26-0318 or a successor resolution.

 

BE IT FURTHER RESOLVED, that this resolution shall sunset when energy expenses incurred by the Forest Preserves are no longer required to be reported to the Forest Preserves of Cook County Board of Commissioners.
