PROPOSED RESOLUTION
PROPOSED RESOLUTION AUTHORIZING A PETITION FOR DISCONNECTION OF CERTAIN REAL PROPERTY FROM THE ROSEMONT PARK DISTRICT
WHEREAS, the Forest Preserves of Cook County (the “Forest Preserves”) is the owner of real property, cumulatively totaling approximately 22 acres, located in the unincorporated area of Leyden Township identified by the following Property Index Numbers:

(collectively, the “Property”), all of which are located within the boundaries of the Rosemont Park District (the “RPD”); and
WHEREAS, disconnection of the Property from the RPD will remove the Property from the RPD territory which is not within the corporate limits of the Village of Rosemont (the “Village”) and thereby facilitate the possible consolidation of the RPD with the Village; and
WHEREAS, Section 1205/3-6 of the Park District Code (70 ILCS 1205/3-6) authorizes the corporate authorities of the RPD to adopt an ordinance disconnecting any territory within its boundaries, which (1) is upon its border and (2) if disconnected, would not separate any part of RPD, upon a written petition signed by the majority owners of record of the land and the owners of record of more than one-half of the area of land in the territory described in the petition; and
WHEREAS, the Property is located upon the border of the boundaries of the RPD; and
WHEREAS, the disconnection of the Property from the RPD will not separate any part of the RPD from any other part of the RPD; and
WHEREAS, no assessments are due to the RPD from the Forest Preserves, and no assessments are due to the Forest Preserves from the RPD, with respect to the Property; and
WHEREAS, the Property is uninhabited, exempt from property taxation, and the Forest Preserves does not otherwise receive any services from the RPD; and
WHEREAS, disconnection is in the best interests of the Forest Preserves, the RPD, and the residents they both serve; and
WHEREAS, disconnection of the Property does not change ownership of the Property, and the Forest Preserves will remain the owner of the Property post disconnection.
NOW THEREFORE, BE IT RESOLVED, by the Forest Preserves of Cook County Board of Commissioners that the recitals set forth in the preamble of this Resolution are true and correct and are adopted and made part of this Resolution as if fully set forth herein; and
BE IT FURTHER RESOLVED, that the Forest Preserves of Cook County Board of Commissioners does hereby authorize the Forest Preserves to petition the RPD for the disconnection of the Property therefrom and does further authorize the President of the Forest Preserves Board to execute any and all documents required or deemed necessary and desirable to effectuate such petition.
